Regulated vs Offshore Forex Brokers: Leverage, Protection and Tax

Updated 30 October 2026 · Written by Broker Atlas Guides Desk · Data checked by Broker Atlas Data Desk

Short answer

A regulated broker (EU, UK, Australia) caps retail leverage at 30:1 on major pairs, must offer negative balance protection and is backed by a compensation scheme if it fails. An offshore broker offers 1000:1 or more, bonuses and low deposits, but supervision is lighter and there is usually no compensation scheme. Tax is set by where you live, not where the broker is.

Margin needed to open 1 lot: 1:25 $4,400, 1:100 $1,100, 1:500 $220, 1:1,000 $110
EUR/USD at 1.10. Higher leverage lets you open the same 1 lot with less margin; the profit or loss per pip stays the same.

The short version

Regulated (EU example) Offshore
Major FX leverage 30:1 Typically 500:1 to 1000:1; some go higher
Gold / major indices 20:1 Often 500:1 or more
Crypto CFDs 2:1 Often 100:1 or more on some accounts
Negative balance protection Mandatory Optional; check the broker
Margin close-out At 50% of required margin Set by each broker
Bonuses Restricted Common
Compensation scheme Yes Usually none

The EU column comes from ESMA’s CFD measures. Offshore figures vary by broker; examples follow.

Leverage: the main reason people go offshore

Take one standard lot of EUR/USD at 1.0800, a $108,000 position.

  • At 30:1 you need $3,600 of margin.
  • At 1000:1 you need $108.

The risk per pip is the same in both cases, about $10. What changes is how small an account can hold the trade, and how quickly it can be wiped out. Work your own numbers in the margin calculator, and read leverage explained before you rely on high ratios.

Offshore figures from our database: XM Global up to 1000:1, BigBoss up to 2222:1 (falling as balance grows), XS.com up to 2000:1 on accounts with a $500 minimum deposit, and FXGT up to 5000:1. Compare them on high-leverage brokers.

Protection: what each licence covers

Regulated brokers must keep client money segregated and belong to a compensation scheme. If a UK firm fails, the FSCS can pay up to £85,000 per person. In Cyprus, the Investor Compensation Fund pays the lower of 90% of your covered claim or €20,000. Neither covers trading losses.

Offshore brokers are licensed and supervised, but more lightly, and the offshore regulators’ sites we read don’t describe a compensation scheme. If an offshore broker becomes insolvent, you are a creditor. That is why the size of your deposit matters more than the brand. Read segregated funds and compensation.

Tax: the same either way

Tax depends on your country of residence. Some systems treat gains from locally licensed dealers differently from offshore ones. Japan is one example: its tax agency taxes qualifying FX contracts separately at a flat rate and other FX gains as miscellaneous income at progressive rates (National Tax Agency, No.1521). See our forex tax guide and check your own tax authority.

Which one should you pick?

  • Regulated if the account holds a meaningful share of your savings, or you want compensation cover.
  • Offshore if you want high leverage on a small, risk-only balance and you accept that protection is weaker.

If you go offshore, keep deposits small, withdraw profits regularly and check the licence yourself (how to spot a scam broker). The safest offshore brokers page ranks options by licence.

Frequently asked questions

Is a regulated broker always safer?

For the safety of your deposit, yes: stricter rules on client money and a compensation scheme make a real difference. It doesn't protect you from trading losses.

Do I pay less tax with an offshore broker?

No. Your tax depends on where you are resident. Using an offshore broker doesn't change what you owe, and in some countries it changes how gains are classified, sometimes for the worse.

Why is leverage limited at regulated brokers?

EU regulators limited retail CFD leverage in 2018 to reduce client losses: 30:1 on major FX, 20:1 on gold and major indices, down to 2:1 on crypto.

Can I use both?

Yes. Many traders keep their main capital with a regulated broker and use a small offshore account for high-leverage trading.
